Owning property in Chennai while living in Dubai, Singapore, London or New Jersey is common, and stressful. You can't drop by to check a flat, meet a buyer or sort out a leaking pipe. Every decision happens over a video call, in a different time zone, often through relatives who have their own lives to run.
That's where an NRI real estate consultant comes in. A good one does more than find a property. They take care of the legal checks, the paperwork the Reserve Bank and the tax department require, and the long-term care of the home.
This guide explains what an NRI real estate consultant does, the 2026 rules every NRI should know before buying or selling in Chennai, and how to choose a consultant you can trust.
What an NRI Real Estate Consultant Does
Buying property in Chennai as an NRI
The consultant becomes your on-site buyer. They visit shortlisted homes on video, check the neighbourhood and water supply, verify documents with a lawyer, and represent you at the sub-registrar's office through a registered power of attorney. Start with our property buying checklist for NRIs investing in Chennai and RAPRO's buying assistance.
Selling property in Chennai from abroad
Selling from overseas is where most NRIs get stuck, because of TDS and repatriation rules. A consultant prices the property on real comparable sales, finds and screens buyers, and works with your CA so the right tax is deducted. See RAPRO's selling assistance and the Padur villa sale case study.
Renting and managing from abroad
After the deal, the consultant finds tenants, collects rent, pays your property tax and handles repairs. Read how NRIs can manage rental properties in Chennai remotely and explore RAPRO's NRI property management.
Protecting your property
Empty homes and plots are at risk of damage, encroachment and illegal occupation. A consultant inspects regularly and acts fast. See how to protect an unoccupied property in Chennai and RAPRO's plot monitoring service.
NRI Property Rules in 2026: What Your Consultant Should Know
A good NRI real estate consultant knows these rules well and works with your chartered accountant and lawyer.
This section is general information, not legal or tax advice; confirm your case with a CA.
What NRIs can and can't buy
According to the Reserve Bank of India, NRIs can buy any residential or commercial property in India under general permission, with no need to file documents with the RBI. NRIs cannot buy agricultural land, plantation property or a farm house.
How you must pay
Payment must come through normal banking channels: an inward remittance from abroad, or a debit to your NRE, FCNR(B) or NRO account. The RBI doesn't allow payment by traveller's cheques or foreign currency notes.
Power of attorney
If you can't travel for registration, a registered power of attorney lets a trusted person or your consultant sign and register on your behalf. It usually needs to be signed and attested at the Indian embassy or consulate, or notarised and apostilled abroad, then adjudicated with stamp duty in Tamil Nadu. Keep the PoA specific to the property and the task.
TDS when an NRI sells property
When you sell, the buyer must deduct tax at source (TDS) on the full sale price, not just your profit. For FY 2026–27, the base rates are 12.5% on long-term gains (property held over 2 years) and 30% on short-term gains, plus surcharge and 4% cess (Agrawal Khandelwal):
Because TDS is on the full price, it's often far more than your actual tax. You can apply for a lower deduction certificate before the sale (Form 13, now Form 128 under the Income-tax Act 2025) through the TRACES portal. Processing typically takes 4 to 8 weeks, so your consultant should plan for it early.
Tax on rental income
Tenants paying rent to an NRI landlord must deduct TDS at a higher rate than for resident landlords. Your consultant should coordinate this with your tenant and CA so you can claim the credit when you file your return. Our NRI property tax guide explains TDS, income tax and repatriation in more detail.
Repatriating your money
- Sale proceeds: For property you bought, you can usually repatriate up to the amount you originally paid in foreign exchange or from your NRE or FCNR account. For residential property, this is limited to two properties (RBI).
- The USD 1 million facility: NRIs can remit up to US$1 million per financial year from NRO balances, including sale proceeds and inherited assets, with documentary evidence and tax clearance (Forms 15CA and 15CB, now Forms 145 and 146).
How to Choose an NRI Real Estate Consultant in Chennai
When you can't be there in person, trust matters more than anything. Check these before you sign:
- A real Chennai office. Visit it on your next trip, or ask a relative to. A phone number and a WhatsApp profile aren't enough.
- TNRERA registration for agents and consultants handling registered projects. Check it on the TNRERA website.
- Proven NRI experience. Ask how many NRI clients they serve, in which countries, and for references in your time zone.
- Legal and tax partners. They should work with a property lawyer and a CA who handles NRI tax.
- Clear, written fees for each service: buying, selling, renting and management.
- Remote reporting. Photo and video updates, monthly statements and a single named contact.
- A full service range, so you don't need a different firm for buying, renting, repairs and selling.
Red Flags When Hiring a Consultant From Abroad
- They ask for a broad, open-ended power of attorney covering all your assets
- They want money sent to a personal account instead of the company's
- They can't explain TDS or repatriation clearly
- They push you to buy without a lawyer's title check
- They have no office address and no verifiable reviews
- They go quiet after payment, or only send updates when you chase them
8 Questions to Ask an NRI Real Estate Consultant
